Last.fm offers royalties

On july 1 Last.fm launched the "Artist Royalty Program". This lets artists on Last.fm accrue royalties whenever their songs are streamed. This affects only independent artists, ie. musicians not affiliated with a label or royalty collection agency.
If you haven't done already, upload your music to Last.fm, otherwise head straight to the Music Manager, to sign up. But remember, it's only rock'n'roll.

Mag een openbare bibliotheek een 'veiligheidskopie' maken van een cd of een dvd?

Het antwoord op deze vraag en andere veelgestelde vragen ivm. auteursrecht in de muziekafdeling van de openbare bibliotheek, vind je op de blog van de VVBAD (Vlaamse vereniging voor Bibliotheek-, Archief- en Documentatiewezen) "Veel gestelde vragen i.v.m. auteursrechten in de muziekafdeling van de openbare bibliotheek". Dit gaat natuurlijk niet over werken met een Creative Commons licentie. Je vindt er ook een erg handige link naar een zeer uitgebreid overzicht van links ivm. de belangrijkste wetgeving van het eeuwig moeilijke auteursrecht.

"Met alle Chinezen" (Hasselt) is een benefiet ten voordele van de slachtoffers van de aardbeving in het Chinese Sichuan, op initiatief van de rockband COEM en in samenwerking met het Rode Kruis. Met het verzoek van de organisatoren om de rechten van de auteurs te 'neutraliseren' in de vorm van een gift gaat Sabam niet akkoord, 'omdat het geld naar het buitenland gaat'. Maw. men zou beter een benefiet organiseren voor alle Chinezen in België die familie hebben in Sichuan ...

Sabam biedt jeugdhuislicentie aan

Sinds mei 2008 mogen jeugdhuizen kopies van "legaal verworven geluidsdragers" afspelen. Het voordeel om een kopie af te spelen is archivistisch: het biedt een garantie bij diefstal, beschadiging of slijtage van de originele geluidsdragers. Het is natuurlijk ook erg handig als de muziek vanaf een computer wordt afgespeeld. Het jeugdhuis betaalt wel 251 € + 6% BTW per jaar.

nieuwe Sabamsite

Sinds 14 mei steekt de website van Sabam in een nieuw jasje. Men heeft nu de mogelijkheid om de database van het repertoire van artiesten te raadplegen. Men kan met een tarievensimulator ook het te betalen bedrag voor een evenement met Sabam-werken berekenen. De nieuwe site is van start gegaan 1 dag nadat Open Vld -volksvertegenwoordigers Bart Tommelein en Sofie Staelraeve Sabam nog eens op de vingers hadden getikt ivm. de transparantie bij de beheersvennootschap.

Under the bombastic subtitle "The European Digital Music Revolution" a new web community is just born, Younison:

In the FAQ there's an explanation for the subtitle:

the balls of Brussels

The balls of Brussels - the Atomium - were built for Expo '58 and exist 50 years. The architect of the project Waterkeyn decided to protect 'his' concept by putting his rights to the collecting society Sabam. So, everytime someone wants to put a photo of the Atomium on his website, he has to pay about 90,00 euro/month. One estimates that the income of all payments to Sabam ammounts to about 30.000 euro/year, and this goes to the heir of the late architect (he died in 2005) till + 70 years after his death = 2075. Because this year is the anniversary of Expo '58, the organisation of the Belgian heritage in Mechelen planned to do actions whereby people would send their old pictures of those old days, and to put them on the web, blogs, ... Because of the Sabam rule, the organisation did a playful call ("cultural guerilla") for 100 people to help 'photoshop' away the balls on all the photographs.
Sabam replied that this year is an exception, and people can publish for 1 year the images, as long it's in a non commercial way.

Now i wonder, who ever paid this building, and who owned it then (and now). I mean, if this building is paid by taxes, i should think that the belgian state owns this building and all it's plans, and that the architect made it as an employee of the same state, and has no right to put a copyright on plans made for his employer. Can anyone help me sort this out?

Sabam digs Creative Commons

Update (and now it's becoming more clear):
In a reaction Sabam states that there is nothing new under the sun: members always have been able to reject some parts of their rights management. New is the fact that one can reject the online management by Sabam, i.e. one can manage his music online, both downloads and streaming. The best way to do this is with a Creative Commons license.
Note: if you reject this service, it is applied to the whole of works, not for individual works. But this does not mean that you have to put your whole catalogue on the web.
Conclusion: i interprete this that you can release a CD under Sabam and let them earn moneyfor you, and in the mean time you can also put this release online with a Creative Commons license. This is a big step forward, but some questions remain like: what about a non-profit party where i play the downloaded songs, instead of the CD, do i have to pay or not?

According to the popular portal for popmusicians "Poppunt" the Belgian collecting society Sabam will tolerate that her members use the Creative Commons license for their creative products. What I understand is that a member needs to revoke his Sabam membership for a certain part of his copyright management. This applies to the whole of artist's work. The artist can for example choose to manage his music online, and let his work free in pubs, shops, dj-sets, movies. The rest of the article is too confusing for me, so any help/comment is welcome.

At least, without being pretentious, I think we can be proud of ourselves to have stimulated and influenced the discussion on this high level, thanks to our debates "Is er muziek na Sabam?" & "Studiedag: auteursrechten en de kleine organisator" and reporting about CC in Belgium.

Marco blogt er nog eens op los: "Het ontstaan van de Punk zo rond ‘77 is te danken aan een groep musici die zich gingen verzetten tegen de muziekindustrie. Waarom kan nu niet hetzelfde gebeuren? BUMA(nvdr. = nederlandse Sabam)-muziek is niet beter dan de vrije muziek die je op internet kunt vinden. Waarom gaan de nieuwe webloggers zich niet focussen op vrijere artiesten en bands? Vlaamse Jeugdraad reikt Klein Duimpje trofee uit aan Ankie Vandekerckhove, Boze reus prijs gaat naar Sabam. De VJ zegt dat de werking van Sabam niet transparant is, de communicatie slecht, de tarieven te duur, haar praktijken te intimiderend en ze klaagt de monopoliepositie aan.

trip to the balls of Brussels

Last monday, my office offered me and my colleagues a trip to the Atomium in Brussels. It was a nice trip: this building has an eternal coolness, while it's wrapped in fifties nostalgia. All by all: you should see this piece of art.
But that's where it gets interesting for us: this building has a copyright, ie. when i publish a picture of this copy of an Iron crystal on my website i should pay the Belgian collecting society Sabam (no panic, the picture on my blog is not a picture or copy, it's just a link pointing to the server of the Atomium). So, if i want to publish a picture that i took of this building, constructed and built by tax money, i have to pay royalties to the family of the architect (+ 70 years after his death in 2005) ... Now, that is when i start to think this should be called corruption :-(
Well, the guys at indymedia.be have found a solution to this problem :-D (article in Dutch, picture in universal).

Vorige zaterdag was er het debat in Belsele "Studiedag: auteursrechten en de kleine organisator". Je kan bij Marco Raaphorst al een kort verslag lezen, en binnenkort komt hier een uitgebreid verslag.
Wat we ondertussen onthouden:
- de bewijslast ligt bij Sabam, dwz. ik draai een hele avond Creative Commons-muziek, Sabam zegt dat er een aantal nummers van Sabam-auteurs zijn: welnu, zij moet dat bewijzen;
- Sabam is haar agentschappen aan het omvormen: geen zelfstandige bvba'ers meer, maar wel zelfopgeleide en beëdigde inspecteurs;
- als ik een benefiet geef met artiesten aangesloten bij Sabam die gratis optreden, gaat sowieso een deel van de opbrengst niet naar bvb. Music for Life, wel naar het 3de zwembad van Madonna;
- ...

Volgende dinsdag komt er weer het volgende Sabam debat aan!

The people at Krill Konzern Recordings have constructed a new license: License pro Piracy / Licence Pro Piratage.
Krill: "Although we authorize and encourage you to do so, taking this CD, copying it or exchanging it freely will make you a pirate. Because piracy is also a matter of rights and freedom, we choose the pro-piracy licence."
In my opinion this is not really true, I think this act does not make the listener a pirate, but the artists make themselve a pirate ...

Sabam: "De Belgische Vereniging van Auteurs, Componisten en Uitgevers (SABAM) heeft via de pers (Le Soir, 16.08.2007) kennisgenomen van de inhoud van de drie nota's van formateur Yves LETERME in verband met de Vlaamse eisen voor de vorming van de volgende federale regering. De communautarisering van SABAM en de auteursrechtwetgeving maakt duidelijk deel uit van die eisen."

en dan komt het:

"Over het algemeen betreuren de vennoten van SABAM dat men één van de laatste culturele linken tussen de verschillende gemeenschappen van ons land wil verbreken."
